UZURV Privacy Policy

This Privacy Policy describes the personal information UZURV Holdings, Inc. (“UZURV”) may collect, process, retain, use, or disclose to UZURV’s Affiliates, Users, service providers, or third parties in connection with providing the UZURV Services or the UZURV Platform, or to engage in any of the activities described in this Privacy Policy.  Personal information includes any information or data that identifies or could reasonably be used to identify you as an individual.  UZURV’s Terms of Service are incorporated by reference in its entirety, including the definitions for capitalized terms that are used in this Privacy Policy but not separately defined herein. 

 

A. PERSONAL INFORMATION COLLECTION AND USES

 

1. PERSONAL INFORMATION PROVIDED BY YOU

a. User Account Information.  When you create an Account, we collect the information that you provide us, which may include but is not limited to your full name; date of birth; identity verification information, such as your driver’s license or other government-issued identification documents; email address; phone number; home address; User profile photo, Account login and password; and credit card and other billing/payment information.  You may choose to share additional information with us, such as creating a saved list of your “favorite” addresses, accessibility settings and other personal preferences, and notes regarding your individual mobility needs.

b. Driver Information.  If you apply to be a Driver, we collect the information you provide in your application, including but not limited to your full name; date of birth; home address; identification information such as your social security number or other government-issued identification documents; driver’s license information; vehicle information; vehicle insurance information; payment related information such as your bank account and routing numbers, and tax information; and any other information relevant to your eligibility and qualifications under applicable company policies and procedures, laws, regulations, or local transit authority requirements.  We may also periodically collect updates to the information described herein.

c. User Communications.  We collect information you communicate to us, including but not limited to information you communicate to UZURV (or UZURV’s service providers) through emails, phone calls (which may be recorded or transcribed), text messages, website chatbots, in-app chats or messaging systems, or questionnaires/survey responses.  The information that you communicate to us may include User demographic data, feedback or ratings of the UZURV Services or the UZURV Platform, and information related to motor vehicle accidents, incidents, or other claims.  We may also collect the information you communicate to UZURV’s direct or indirect contracting parties regarding the UZURV Services or the UZURV Platform, including but not limited to local transit authorities and their service providers.

 

2. PERSONAL INFORMATION COLLECTED WHEN YOU USE THE UZURV SERVICES OR THE UZURV PLATFORM

a. Transportation Information.  We collect information regarding Transportation that is coordinated through the UZURV Services or the UZURV Platform, including but not limited to the details of a Rider’s request for Transportation; a Driver’s decision to accept a Rider’s request for Transportation; pick up and drop off times and locations; duration/completion time; and any notes, comments, reports, feedback, or other communications provided by a Rider, Driver, or any other party about the Transportation.  

b. Location Information.  We automatically collect location information through the UZURV Platform mobile application and third-party software, including, but not limited to approximate or precise location information in real-time through GPS and other telematics systems, or through other technologies such as WiFi, Bluetooth, or IP addresses. We may collect this data when the application is running on your mobile device’s foreground (i.e. the application is open and visible on your mobile device’s screen) or background (i.e. the application is open but not visible on your mobile device’s screen). In addition, we may use on-device tools to provide you with location-based notifications without collecting your precise location, such as when you are at the airport or near other landmarks.  In such cases, your location information is processed locally on your device, and we may receive your location information if you tap on the notification to engage with UZURV. 

c. Device Information. We collect information about the devices you use to access the UZURV Platform, including your application installations; device ID; device manufacturer/model/type; operating system version; web browser type; wireless service carrier or internet service provider; cellular data; internet protocol address; domain name; referring/exit webpages; advertising identifiers and clickstream data; push notification tokens; location; date/time information; Apple Intelligence data; and motion and fitness data.  We may also collect mobile sensor data from your device (such as speed, direction, height, acceleration, deceleration, camera, and other technical data).  

d. Cookies, Analytics, and Tracking Technologies.  We collect information through cookies, tracking pixels, data analytics tools such as Google Analytics and Lucky Orange, SDKs, and other tracking technologies on the UZURV Platform, which includes UZURV’s website pages and mobile device applications.

 

3. PERSONAL INFORMATION COLLECTED FROM OTHER SOURCES

UZURV may collect information from various other sources, including UZURV’s service providers; UZURV’s direct or indirect contracting partners (e.g. local transit authorities or their service providers); third-party websites; law enforcement and other governmental agencies; insurance companies; banks, credit card companies, and other finance companies; and publicly available records.

a. Driver background check information. We collect Driver background check information, including but not limited to the Driver’s driving history, accidents/incident reports, criminal records, and identity verification information. We may also collect information regarding a Driver’s physical examinations and drug and alcohol testing when required under applicable laws or legal requirements, or upon the Driver’s voluntary opt-in to provide this information to UZURV.

b. Insurance information.  We collect Driver insurance information including but not limited to information regarding the vehicles covered, named insureds, types and amounts of coverage, policy expiration/termination dates, and premium payments.   We may also collect insurance information regarding or relating to the UZURV Services, the UZURV Platform, or any User in certain situations, such as part of an investigation of an automobile accident or other incident.

c. Financial information.  We collect your financial information, including but not limited to banking, credit card, and transaction processing information.

d. Marketing information.  We may collect information from third parties which refer or direct you to UZURV or the UZURV Platform, including but not limited to your name, contact information, and your web browsing history, trends, or preferences.  This information may be collected by the third parties through cookies, tracking pixels, data analytics tools such as Google Analytics and Lucky Orange, SDKs, and other tracking technologies on the third parties’ website pages or electronic device applications.

e. Local Transit Authority Programs.  If you use the UZURV Services or the UZURV Platform through your participation in a local transit authority program, we may collect any of the types of information described in this Privacy Policy from the local transit authority (or its service providers).

f. Enterprise Programs. If you use the UZURV Services or the UZURV Platform through your employer or any other type of corporate organization, we may collect any of the types of information described in this Privacy Policy from such corporate organization (or another party acting on its behalf).

g. Referrals.  If someone refers you to UZURV, we will collect information about you from that referral, including your name and contact information.  

h. Legal Investigation & Compliance.  We may collect information through law enforcement, lawsuits or other legal proceedings, government agency actions, or other legal and regulatory matters.  

*Please note that the UZURV Services and the UZURV Platform are not intended for use by children under 18 years of age. UZURV does not intentionally collect the personal information of any individual under 18 years of age.  If we learn that we have inadvertently collected personal information from a child under 18 without the consent of the child’s parent or guardian as required by law, we will delete it.

 

B. HOW WE USE YOUR INFORMATION

  1. We use your personal information to provide the UZURV Services and the UZURV Platform, including but not limited to verifying your identity and maintaining your Account; connecting Riders that have requested Transportation with Drivers who may agree to provide Transportation to the Rider; tracking the progress of Transportation; calculating fares and earnings and processing payments; communicating with Users, service providers, and UZURV’s direct or indirect contracting partners about the use of the UZURV Services and the UZURV Platform; and providing technical and service support.  We use your personal information in connection with certain automated processes to operate the UZURV Platform, including processes that match Rider requests for Transportation to Drivers who may be available in the relevant geographic location to accept the request for Transportation.
  2. We may use your personal information to update or improve the UZURV Services and the UZURV Platform, including but not limited to research, testing, and analysis; development of new or updated products, features, operational processes, security protocols, partnerships, and services; customizations based upon your preferences, feedback, or usage patterns; and to find and fix software bugs, errors, malfunctions, compatibilities, vulnerabilities, or other quality issues. 
  3. We may use your personal information for marketing, advertising, and other promotional purposes, including but not limited to providing you with marketing, advertising, incentives, offers, or promotional communications that are personalized to you based upon your Account information, your use of the UZURV Services and the UZURV Platform, or any feedback that you have provided to UZURV or UZURV’s direct or indirect business partners (including, for example, a local transit authority).
  4. We may use your personal information to enforce or comply with UZURV’s Terms of Service, UZURV’s Privacy Policy, and any other applicable contractual requirements, local transit authority program requirements, policies, procedures, laws, and regulations.  These uses may include but are not limited to authenticating, verifying, or qualifying Users against any applicable legal, regulatory, or program eligibility requirements; verifying that Drivers and their vehicles meet safety, regulatory, contractual, or operational requirements; preventing, investigating, or resolving allegations, complaints, lawsuits, arbitrations, incidents, accidents, or insurance claims; detecting, preventing, or mitigating against fraud, abuse, or other wrongdoing; and reporting regarding or relating to any of the aforementioned uses and purposes.  We may also use your personal information in connection with legal actions and proceedings that we or you are involved in, or to respond to requests or demands from government entities, law enforcement, regulatory agencies, court orders, subpoenas, or other compulsory legal processes seeking such information.

 

C. HOW WE SHARE YOUR INFORMATION

1. Sharing Between Users of the UZURV Services or the UZURV Platform

a. Rider Information Shared with Drivers.  Each Rider request for Transportation is shared with one or more Drivers who may be available in the relevant geographic location to accept the request for Transportation.   The Rider’s Account information, including but not limited to the Rider’s name and personal mobility needs, as well as details regarding the requested Transportation, including but not limited to the pickup time, pickup location, drop off location, and individual mobility needs (e.g. request for a wheelchair accessible vehicle) may be shared with the Drivers.  If a Driver accepts the Rider’s request for Transportation and provides the Transportation to the Rider, additional information about the Rider may be shared with the Driver, including but not limited to the Rider’s notes, comments, or feedback about the Driver or the Transportation provided. 

b. Driver Information Shared with Rider.  If a Driver accepts a Rider’s  request for Transportation, we will share with the Rider the Driver’s name; profile photo; vehicle information, including make, model, color, and license plate number; and real-time location. Drivers may also communicate with Riders through the UZURV Services or the UZURV Platform.

c. Other Communications Between Riders and Drivers.  Riders may communicate with Drivers through the UZURV Services or the UZURV Platform and vice versa, in which case personal information included in such communications is shared with each recipient of the communication.  If a Rider or Driver reports a lost or found item to us, we may seek to connect the reporting party to the relevant party in an attempt to return the item.

d. Transportation Requested or Paid for by Others.  If the subject Transportation is requested or paid for by another party (including but not limited to a corporate entity, employer, or a transit authority or its service provider), we may share with such party your Account information and details regarding the Transportation, including but not limited to pick up time; pickup location; drop off time; drop off location; notes, comments, or feedback about the Rider, Driver, or the Transportation; any reports regarding motor vehicle accidents, incidents, complaints, or insurance claims; and payment related information such as tolls, costs, fees, and surcharges.

e. Referring parties. If you refer someone to UZURV, we may let them know that you generated the referral, including sharing your name.  If another party referred you, we may share information about you with the referring party including your name, your use of the UZURV Services or the UZURV Platform, and other details that may be relevant to the referral such as an applicable bonus, incentive, or similar promotion offered by UZURV to the referring party.

2. Sharing with UZURV’s Service Providers and Other Contractual Partners

We do not sell your personal information to a third-party for its own use or purpose, and we will not engage in a sale of your personal information to a third-party for its own use or purpose without first giving you prior written notice and the opportunity to exercise your legal rights regarding such sale.  Depending on whether you are a Driver, Rider, or another type of User of the UZURV Services or the UZURV Platform, we may share the following categories of personal information to UZURV’s service providers and other parties with a contractual relationship with UZURV regarding, relating to, or in connection with the UZURV Services or the UZURV Platform:

  • Personal identifiers, such as your name, address, email address, phone number, date of birth, social security number, and other government issued identifiers, driver’s license information and image, Account profile photo, vehicle information, and vehicle insurance information.
  • Financial information, such as bank routing numbers, tax information, and any other payment information you provide us.
  • Transportation information, including but not limited to pickup time; pickup location; drop off time; drop off location; usage history; notes, comments, or feedback about the Rider, Driver, or the Transportation; any reports regarding motor vehicle accidents, incidents, complaints, or insurance claims; and payment related information such as tolls, costs, fees, and surcharges.
  • Internet or other electronic network activity information, such as your IP address, type of browser, version of operating system, carrier and/or manufacturer, device identifiers, and mobile and other forms of advertising identifiers.
  • Location data.
  • Marketing, promotional, referral, and incentives related information, including your UZURV Services or UZURV Platform usage history and patterns; comments, feedback, ratings, suggestions, and responses to surveys.
  • Inferences we may make from your interactions with the UZURV Services and the UZURV Platform, and other personal information available to us.

We may disclose these categories of personal information to UZURV’s service providers or other parties that UZURV has a contractual relationship with in order to provide, improve, update, or market the UZURV Services and the UZURV Platform, and for legal, regulatory, and contractual compliance purposes including but not limited to verifying User identity, age, program eligibility, and other relevant qualifications; processing Driver applications; insurance claims; engaging in advertising campaigns, which may include targeted and cross-contextual behavioral advertising on the UZURV Platform; administering UZURV rewards or inventive programs; contact and engage emergency services; detecting, reporting, or preventing fraud, misconduct, or unsafe activities.

 

3. Sharing With Parties Involved with Legal, Regulatory, or Compliance Activities

We may have a legal obligation to disclose your personal information to other parties, including but not limited to the following situations:

  • To enforce UZURV’s Agreement, including the Terms of Service, this Privacy Policy, and any other applicable policies, procedures, or contractual requirements.
  • To respond to a subpoena, court order to produce documents or information, a law enforcement or government agency inquiry, or any other legal or regulatory request for such information.
  • For UZURV or UZURV’s direct or indirect contractual partners (e.g. a local transit authority) to comply with any applicable federal, state, and local laws and regulations, including requirements or obligations arising out of permitting or licensing requirements, audits, and any legal or regulatory investigations, actions, lawsuits, processes, or proceedings.
  • To monitor, detect, prevent, or mitigate against conduct or activity that we reasonably believe may violate any applicable law or regulation, or that may cause serious harm or injury to UZURV, UZURV’s direct or indirect contractual partners, any User, or the general public.

 

4. Sharing In Connection with a Merger or Acquisition

We may disclose your personal information to third parties in connection with a merger, acquisition, divestiture, restructuring, bankruptcy, sale of assets, or other similar corporate transaction involving UZURV, including during the negotiation phase, whether or not such transition is ultimately completed.

5. Sharing Upon Your Direction or with Your Consent

We may disclose your personal information to third parties for purposes or uses that are not addressed in this Privacy Policy with your permission or at your direction.

 

D. PERSONAL INFORMATION RETENTION AND STORAGE

We retain your personal information for the longest of the following time periods:

  • As long as your UZURV Account is open;
  • As long as necessary to provide the UZURV Services and the UZURV Platform to you;
  • As long as necessary for UZURV to perform its business activities and functions, including but not limited to finance, accounting, tax functions, as well as reporting, audit, and recordkeeping obligations in connection with UZURV’s direct and indirect contractual partners (e.g. local transit authorities or their service providers);
  • As long as necessary for UZURV to comply with its legal and regulatory obligations, including but not limited to enforcing UZURV’s legal rights or requirements, resolving lawsuits and other types of disputes, or as otherwise required by law; or
  • 7 years from the date the information was first provided to us.

We have implemented administrative, technical, and physical security controls intended to safeguard your personal information. However, we do not represent, warrant, or guarantee that the UZURV Services, the UZURV Platform, or any other third-party system that integrates or interacts with the UZURV Services or the UZURV Platform are error-free or 100% secure against hackers, malware, or any other circumstance that could result in an unintended disclosure of your personal information. Please keep this in mind when you share your personal information with us, and take reasonable measures to protect your information, including using complex passwords for your Account, changing your Account password frequently, refraining from sharing your Account password with others, and using a secure browser and device. If you believe your Account has been accessed by an unauthorized individual, please contact us immediately.

 

E. YOUR RIGHTS AND CHOICES REGARDING YOUR PERSONAL INFORMATION

General.  You may request confirmation of whether we process your personal information and request a copy of the person information we hold about you.  Where required by applicable law, we will provide this information at no cost to you.  You may request that we correct inaccuracies in the personal information we maintain about you.  You may request that we delete your personal information, subject to any exceptions or exclusions stated in this Privacy Policy or under applicable law.  We will not discriminate against you for exercising any of your rights pursuant to this Privacy Policy or any applicable laws; provided however you acknowledge and understand that certain personal information may be necessary for us provide the UZURV Services or the UZURV Platform (or certain features or functions thereof) to you.

Reviewing and Correcting Account Information. You can review and edit certain personal information by logging in to your Account.  You may correct your personal information if it is inaccurate by editing it in your Account, or by contacting UZURV support at [email protected]/.  Please note that UZURV may need to verify your identity prior to making changes to a User’s Account information.

Email Subscriptions. You can unsubscribe from our commercial or promotional emails at any time by clicking the “Unsubscribe” button or link contained in those messages. 

Text Messages. You can opt out of receiving commercial or promotional text messages by texting the word “STOP” to the text message from the mobile device receiving the messages.

Push Notifications. You can opt out of receiving push notifications through your device settings. Please note that opting out of receiving push notifications may impact your use of the UZURV Services and the UZURV Platform, such as receiving a notification on your mobile device that your Driver has arrived at the designated pickup location.

Location Information. You can prevent your device from sharing location information through your device’s system settings. You may also control some elements of sharing your location in your Account settings.  Please note that disabling or limiting location information sharing may impact your use of the UZURV Services and the UZURV Platform, such as allowing a Driver to find a Rider at the designated pickup location.

Tracking and Personalized Advertising.  You may opt out of our use of and/or sharing of your personal information for personalized or targeted advertising purposes (as defined under applicable law) by making the applicable selection in your Account settings and preferences, or alternatively, by contacting UZURV support at [email protected].  Your browser and devices may offer some controls regarding whether certain tracking methods are enabled and how they function, including but not limited to cookies and pixel tracking. You may choose to enable (where available) an online universal opt-out preference tool that automatically communicates your opt-out preferences, and we honor these opt-out preferences if they are effectively communicated to us in a format that is compatible with UZURV’s Platform technologies.

Closing your Account.  You may initiate a request to close your Account by using the account deletion feature in the UZURV Platform, or by contacting UZURV support at [email protected]/.  Please note that UZURV may need to verify your identity prior to deleting a User Account.  When we delete your Account, we may still retain, use, or share your personal information for the purposes and the durations described in this Privacy Policy, including without limitation to finish performing the relevant UZURV Services; resolve disputes, lawsuits, or insurance claims; enforce our legal rights or comply with our legal, regulatory, and contractual obligations; or as otherwise required by law.  

 

F. THIRD PARTY SITES AND SERVICES

The UZURV Platform may contain links to third-party websites or applications that are subject to the respective third party’s terms, conditions, policies, procedures, and legal requirements or obligations, including but not limited to privacy policies that differ from UZURV’s Privacy Policy (collectively, the “Third-Party Content”).  UZURV is not responsible for any third party or Third-Party Content. We encourage you to read the applicable Third-Party Content, including but not limited to privacy policies of each third party you visit. Please contact the third party directly if you have any questions about its privacy policies.

 

G. AMENDMENTS AND MODIFICATIONS

We reserve the right to amend, modify, or supplement this Privacy Policy at any time without prior notice to you.  Each time you use the UZURV Service or the UZURV Platform, you are agreeing to the most recent version of this Privacy Policy.  Please check UZURV’s website or the UZURV Platform link frequently to review the most recent version of this Privacy Policy.

 

H. ADDITIONAL INFORMATION

Certain jurisdictions may require additional disclosures to you, such as state-specific privacy or personal information requirements. You can view these disclosures on UZURV’s website at https://uzurv.com/uzurv-terms-and-policies/.
